Although technically a term that we haven't used in the California law books for decades now, 'Divorce' continues to be the most common description of the legal process of returning each party to the status of single persons. California now refers to it as Marital Dissolution in an attempt to reduce the sometimes negative connotation that the word "divorce" brought into the process. By renaming it, the legislature hoped that a marriage might be dissolved in the same way any other legal partnership.

Child Custody is one of the most complex and daunting areas in all of California law for most parties. A determination for both temporary orders and later permanent orders can have dramatic impact on many other areas of the case. Seasoned legal counsel in the area, perhaps as in no other, is critical to arriving at an outcome that addresses your concerns and needs. Let Marcus and Associates help you design, secure and maintain the custody order that best serves the needs of you and your children.

Spouses that fail meet to the court ordered obligations are not only frustrating, but they can create sometimes dangerous situations where needed services are unable to be purchased because of their inaction. Marcus and Associates can help you locate and prosecute non-paying spouses.

Alternately, some claims made by former spouses, now that they have a support order in hand are inaccurate. Marcus and Associates can help you defend unwarranted claims of arrears.

Although many are familiar with so-called guideline support, which is sometimes referred to by the brand name of a software product used to calculate support, Dissomaster™, spousal support remains one of the least understood areas of law by the general public. While many courts may use a Dissomaster calculation for setting temporary support, the final support award at the time of trial must be made upon the factors set forth in the Family Code without the use of the mathematical formula found in the software. The courts consider factors including, age of the parties, their health, education, training, background, history of employment, and reasons for absence from the workplace among others.

Let's face it…kids cost money. Raising them in this economy is a full time job, and the assistance of the non-custodial parent is no longer an option, it's a requirement just to survive. Marcus and Associates help you to establish a support order that addresses the unique needs of your family, or defend you from a custodial parent that is attempting to use your children as pawns in their desire to soak you for additional and unwarranted payments.

The needs of businesses in this economy are both varied and complex. Too often meritless lawsuits are being filed to see if a business is willing to pay off a plaintiff 'just to make them go away'. Just as often clients that have used your services are not paying your invoices. Marcus and Associates can help with both by designing a litigation plan that gets results.

Let Marcus and Associates help you with defense from unwarranted lawsuits, or in aggressively pursuing former business relations that have failed to honor their legal obligations.

At the conclusion of a trial, no money is actually transferred to the prevailing party. The only thing a given to a prevailing party is a Judgment which merely entitles that to payment. Enforcing that judgment against the opposing party remains a top priority of your business litigation needs. Marcus and Associates can help you secure the money behind the judgment and get you paid.

One of the best alternatives to the cost of litigation is a negotiated agreement or settlement. Designing settlements that are both fair and enforceable is the key to a good outcome for our clients. By maintaining a strong tradition of litigation skill, Marcus and Associates can negotiate from a position of strength since the firm is fully prepared to litigate your case if the opposing side is not bargaining in good faith.

There are very few things more frustrating than spending money needlessly on your divorce. The process is expensive enough due to the nature of the process, but there is an entire area of expense often, although inadvertently, created by the clients themselves. In a word, planning, or lack thereof, is probably the biggest time waster (read: expensive) in the entire process.

Oftentimes the filing of a divorce petition brings with it a vast range of emotions on the part of a new divorcee. These emotions can run the spectrum between fear, helplessness, and even the hope for a better future. However, few new divorcees appreciate that with the commencement of the case, several important restrictions immediately take effect which can have a significant bearing on the future of the case. Commonly referred to as the "ATROs" by family law attorneys and judges (standing for "Automatic Temporary Restraining Orders"), these standard restraining orders bind the divorcee upon the filing of the Petition and the issuance of the Summons. Conversely, the ATROs bind the responding party upon the lawful service of the Summons and Petition on that party, most often by the means of personal service. These ATROs remain in effect and binding until judgment of dissolution is entered, the case is dismissed, the judge orders otherwise, or the parties reach a written agreement.
